The sun forward Dylan Brooks Prosecutors in Scottsdale, Arizona, on Monday filed felony driving under the influence charges stemming from a March arrest, according to Report by TMZ and ESPN’s Michael Rothstein.
Brooks is scheduled to be arraigned on the Class 1 misdemeanor charge on Oct. 28.
“We have reviewed the matter with Dylan and have no further comment.” Suns senior vice president of communications Stacey Mitch said in a statement to ESPN.
According to TMZ’s initial report, Brooks was terminated on March 6 for a traffic violation at about 1 a.m. in Scottsdale and charged about half an hour later on suspicion of driving under the influence. Brooks was taken to the Scottsdale City Jail, processed and released from custody around 3:30 a.m.
At the time, a source close to Brooks told ESPN that the arrest was marijuana-related. According to Rothstein, Brooks also has another case pending in the Scottsdale court system. A separate January reckless driving and speeding case is nearing trial, and the court has scheduled a Nov. 9 pretrial conference.
The NBA usually waits for legal cases to be resolved before taking any disciplinary action against a player.
Brooks signed three-year, $73 million extension with Phoenix in August. The veteran forward averaged 20.2 points on 17.1 rebounds per game last season, both career highs, and helped set the tone defensively for a team looking to rebuild its culture.
